OBLIGATION OF LANDLORDS
In the state of Michigan, it is the responsibility of the landlord to provide safe, secure and clean living conditions, which should include:
- Keeping common areas safe and clean and keeping the premises fit for human habitation;
- Insects, rodents and other pests must be controlled;
- Maintaining the roof, foundations and walls and ensuring the unit is kept weather-tight;
- Maintaining plumbing, heating and electrical as well as other equipment and appliances that were provided by the owner;
- Providing suitable containers for garbage and making arrangements for the pickup of garbage;
- When responsible for the provision of heat in rental units during the months of September through June, ensuring that the daytime temperatures between 7a.m.-10:30p.m., are maintained at 65F or above, and that at night time the temperatures are not less than 58F;
- Where accommodations are non-transient, keys for the unit and building entrance doors should be provided, with lock mechanisms and keys changed in most cases when there is a change of tenants;
- Installing smoke detectors and instructing tenants as to how to operate and maintain the premises;
- It is not required of owners to make cosmetic repairs such as installing new carpets or painting, after a tenancy has ended.
OBLIGATION OF TENANTS
In the state of Michigan, a tenant is required to maintain the rental housing in a safe and clean manner, which includes:
- Disposing garbage properly;
- Exercising care when using electrical and plumbing fixtures;
- Repairing any damage caused by either themselves or their guests promptly;
- Ensuring that reasonable access is granted for inspection, repair, pest control and maintenance purposes;
- Maintaining smoke detectors in good working order;
- Refraining from the storage of any dangerous materials on the premises.
